Design Registration in India

Design registration under the Designs Act, 2000 protects the unique aesthetic features of a product - including its shape, configuration, pattern, ornamentation, and the composition of lines or colours - as applied to any article by any industrial process. Design registration grants the owner an exclusive right to use the design commercially and prevents others from manufacturing, selling, or importing products with an identical or fraudulently imitated design.

Requirements for a Registrable Design

  • Not Functionality Only: A design that is purely dictated by the technical function of the article cannot be registered

Design Registration Process

Design applications are filed with the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM), Kolkata. The application (Form 1) is filed with representations of the design (drawings or photographs), a statement of novelty, and the prescribed fee. The application undergoes formal and substantive examination. If accepted, a registration certificate is issued within 3–6 months. If objected to, IPAGAIN handles the reply and if needed, hearing representation.

Protection Term

Design registration is valid for 10 years, extendable by a further 5 years (total 15 years maximum) upon filing an extension application. This period runs from the date of registration, not the filing date.
